I have handled hundreds of drunk driving cases.  There is no one better to understand the criminal aspect and the civil aspect of a drunk driving case. I am able to successfully navigate both the civil and criminal aspects of the case.

Just like in non-intoxication related car wreck, you are allowed to recover damages in the following categories:

  • Past and future medical expenses
  • Lost wages and loss of future earning capacity
  • Property damage and loss of use
  • Past and future physical pain
  • Past and future mental anguish
  • Past and future physical impairment
  • Loss of consortium
  • Disfigurement

One additional area for recovery in a drunk driving case is Gross Negligence to seek punitive damages, which is meant to punish the defendant for his conduct and send a message to never do it again.

Your first priority it to take care of yourself, and seek the appropriate medical attention.  It is also important to document at the scene what happened in the wreck. If you are able, take several photographs of the damage to all the vehicles involved, any tire marks or damage to the roadway, as well as identifying information like street signs and license plates.  If there are any witnesses to the collision, you should get their names and contact information.

Once you have this information, I recommend you consult an attorney.  I offer free consultations and will help you prepare for what to do next.  Most people have never hired an attorney before, and don’t know what to expect.  I will walk you through the process and explain your options to you.

You will need to file a claim with the insurance company.  Be very careful when you are dealing with an insurance company, they do not have your best interest in mind.  Often times, insurance companies will try to force you into a quick settlement without taking into account the full extent of your physical and emotional injuries.

After we work to put together your demand packet to the insurance company, we are often able to settle your case for great value without ever having to file a lawsuit.

I have successfully completed the MADD (Mothers Against Drunk Driving) course for civil lawyers, so that I can be the best advocate for my clients, and fight for the victims of drunk driving cases.

FORTENBERRY IN ACTION.

GIVING VICTIMS A VOICE.

In 2015, Zeke Fortenberry was the lead attorney on a drunk driving case in Collin County, Texas.  Tragically, two teenage boys died as a result of the wreck when the driver of their car was going over 100 mph and lost control of the car.  Blood test results showed the driver’s blood alcohol level was more than twice the legal limit in Texas.
